1. Acceptance of Terms

By signing up for, accessing, or using LeadCatcher's services, you agree to be bound by these Terms of Service. You must be at least 18 years of age to use our services. If you are under 18, you may not use LeadCatcher. If you do not agree to these terms, do not use our services. These terms constitute a legally binding agreement between you ("Client") and LeadCatcher ("we", "us", "our"), governed by the laws of Ontario, Canada.

2. Description of Service

LeadCatcher provides AI-powered missed call response and inbound SMS automation services for local businesses. Our service includes:

• Automated text responses to missed calls within 60 seconds
• AI-assisted inbound SMS conversations for lead qualification
• Booking link delivery to qualified leads
• Integration with third-party booking systems
• A client dashboard for monitoring leads and conversations
• Onboarding, setup, and ongoing support

3. Fees and Payment

Our service is offered on a one-time setup fee plus a flat monthly subscription basis. Fees are billed in Canadian dollars (CAD). The monthly fee is due at the start of each billing period. Failure to pay may result in suspension or termination of your account.

4. Cancellation Policy

You may cancel your LeadCatcher subscription at any time by providing 30 days written notice to hello@leadcatcher.ca. There are no long-term contracts or lock-in periods. The one-time setup fee is non-refundable. Monthly fees paid in advance are non-refundable upon cancellation.

5. Client Responsibilities

As a client, you are responsible for:

• Ensuring your use of LeadCatcher complies with all applicable laws, including CASL
• Providing accurate business information during onboarding
• Obtaining appropriate consent from your customers to receive automated text messages where required
• Keeping your account credentials secure
• Ensuring your booking system is accurate and up to date

6. Prohibited Uses

You may not use LeadCatcher to:

• Send spam, unsolicited messages, or messages that violate CASL
• Engage in any unlawful, harmful, or fraudulent activity
• Impersonate any person or entity
• Transmit any content that is defamatory, harassing, or offensive

7. Limitation of Liability

LeadCatcher is provided on an "as is" basis. We do not guarantee any specific number of leads, bookings, or revenue outcomes. To the maximum extent permitted by applicable law, LeadCatcher shall not be liable for any indirect, incidental, or consequential damages arising from your use of our service.

8. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service or engage in any activity that we reasonably believe is harmful to our platform, other clients, or end users.

9. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes via email. Continued use of the service after changes constitutes acceptance of the updated terms.

11. SMS Messaging Terms

By submitting your information through our website or engaging with a business using LeadCatcher's services, you consent to receive automated SMS messages. The following terms apply to all SMS communications:

• Message frequency varies based on your interaction with the business
• Message and data rates may apply depending on your mobile carrier
• Reply STOP at any time to opt out of SMS messages
• Reply HELP for assistance or contact us at hello@leadcatcher.ca
• Opting out will not affect any other services or communications
• LeadCatcher is not liable for delayed or undelivered messages due to carrier issues

12. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
